European Arrest Warrant issued against Salah Abdelslam by French Justice

USPA NEWS - Further to the arrest of Salah Abdeslam in Molenbeek Friday 18 March, the Minister of Justice wishes to make the following clarifications. A new European arrest warrant was issued against him by the French judicial authorities, in complement of the one issued in November 2015 after Paris Attacks.

Further to the arrest of Salah Abdeslam in Molenbeek Friday 18 March, the Minister of Justice wishes to make the following clarifications. A new European arrest warrant was issued against him by the French judicial authorities.--------------------------- It aims to complement the one that was issued in November 2015 after the attacks in Paris to cover all charges against him. The issuance of this European arrest warrant is the responsibility and the competence of the Paris prosecutor, on the basis of an arrest warrant issued by the investigating judges in charge of conducting investigations.------------------------------------------ The procedure of the European arrest warrant results from a framework decision of the European Union of 13 June 2002. It is based on the mutual recognition of judicial decisions, which follows a principle of mutual trust between judicial authorities EU member states. The grounds for refusing enforcement of a European arrest warrant are limited and based on legal criteria, not of opportunity, such as amnesty, that a decision has already intervened for the same acts in the State, criminal minority, the prescription of the public action.----------------------------------------------------------------------------------------------------------- This procedure replaces, as between Member States of the European Union, the extradition procedure. Unlike extradition, it is an exclusively judicial procedure, in which the executive is not involved. Each year, the French judicial authorities issue about a thousand European arrest warrants, and running in nearly as much from their European counterparts.-------------------- This procedure is simpler and faster than the extradition, since it imposes short processing times: the final decision on the surrender of Salah Abdeslam must be made within 60 days of his arrest, 90 days whether to exercise an appeal to the highest court. The refusal by the person to be surrendered to foreign authorities do not prevent the execution of surrender. The Belgian Federal Prosecutor announced that he would notify the European arrest warrant by the French authorities to Salah Abdeslam very quickly in the day. He was charged in Belgium, which will quickly eases him to speak about on the facts.
